C10 SLO Down – Assumption of Risk, Waiver of Liability & Release Agreement
Avila Beach Golf Resort – Avila Beach, California
Our party desires to enter upon and participate in certain activities associated with the C10 SLO Down Truck Show, located at and operated on the grounds of Avila Beach Golf Resort, Avila Beach, California (the “Property”). The C10 SLO Down Truck Show includes, but is not limited to, classic GM truck displays, vehicle movement and staging, vendor areas, spectator viewing, music, food and beverage service, parking, load-in and load-out operations, and related event activities (collectively, the “Event”).
As lawful consideration for being permitted to enter the Property and participate in or attend the Event, I, on behalf of myself and my entire party, acknowledge, represent, and agree to the following terms and conditions.
Assumption of Risk
I understand that the Event takes place on an active resort and golf course property and involves moving vehicles, vehicle displays, equipment, temporary structures, vendors, pedestrian traffic, alcohol service, and other activities that may be hazardous. I acknowledge that participation in or attendance at the Event exposes me and my party to substantial and serious risks of personal injury, death, or property damage.
I understand that risks may include, but are not limited to:
- Moving or idling vehicles
- Mechanical failures
- Uneven terrain, curbs, pavement, or landscaped areas
- Weather conditions
- Crowds and limited visibility
- Vendor equipment and temporary installations
- Loud noises, music, or exhaust fumes
- Negligent acts or omissions of other participants, spectators, vendors, or third parties
I further acknowledge that any injuries sustained may be compounded by delayed or negligent emergency response.
I knowingly, voluntarily, and expressly assume all risks associated with entering the Property and participating in or attending the Event, whether such risks are known or unknown, foreseeable or unforeseeable.
Release and Waiver of Liability
In consideration for being permitted to enter the Property and participate in the Event, I hereby waive, release, and forever discharge the Event organizers and promoters of C10 SLO Down, Avila Beach Golf Resort, their owners, operators, management companies, sponsors, vendors, volunteers, contractors, affiliates, partners, insurers, and each of their respective officers, directors, employees, agents, and representatives (collectively, the “Releasees”) from any and all claims, demands, causes of action, or liabilities arising out of or related to my participation in or attendance at the Event.
This release applies to any injury, death, or property damage, whether caused by the negligence of the Releasees or otherwise, and includes claims that are known or unknown, foreseen or unforeseen, existing now or arising in the future.
Covenant Not to Sue / Waiver of Subrogation
I agree that neither I nor anyone on my behalf will commence or prosecute any lawsuit or claim against the Releasees arising out of matters released herein. I further waive any right of subrogation by my insurers against the Releasees for payments made to or on behalf of me or my party.
This covenant shall be binding upon me and my spouse, heirs, legal representatives, successors, and assigns.
California Civil Code Section 1542 Waiver
I acknowledge that I have read and understand California Civil Code Section 1542, which provides:
“A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor.”
I hereby expressly waive and relinquish all rights under Section 1542 and assume all risks of claims, known or unknown, arising out of or related to the Event.
Image & Likeness Release
I grant the Releasees the unrestricted right to use my name, image, likeness, voice, and vehicle in photographs, video recordings, and other media captured during the Event for promotional, marketing, or commercial purposes, without compensation or further approval.
Health & Safety Representation
I represent that I and my party are in good health and proper physical condition to attend and participate in the Event. I do not have any medical or physical condition that would impair my ability to safely operate a vehicle or otherwise participate.
I agree that if at any time I believe conditions to be unsafe, or that I am no longer physically capable of participation, I will immediately cease participation and remove myself from the activity.
Event Modifications & Cancellations
The Event reserves the right, in its sole and absolute discretion, to modify, restrict, postpone, or cancel any portion of the Event, including but not limited to vehicle movement, staging areas, activities, schedules, or access to certain areas of the Property, due to safety concerns, weather, staffing, operational issues, or any other reason deemed necessary by the Event organizers or Property management.
Acknowledgment
I ACKNOWLEDGE THAT I HAVE READ AND FULLY UNDERSTAND THIS AGREEMENT. I UNDERSTAND THAT BY AGREEING TO THESE TERMS, I AM VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. AGREEMENT TO THESE TERMS IS A CONDITION OF ENTRY TO THE PROPERTY AND PARTICIPATION IN THE C10 SLO DOWN EVENT.
